{"id":9279,"date":"2019-02-13T09:18:37","date_gmt":"2019-02-13T09:18:37","guid":{"rendered":"http:\/\/re-photo.co.uk\/?p=9279"},"modified":"2019-02-11T10:19:13","modified_gmt":"2019-02-11T10:19:13","slug":"human-rights-70-years","status":"publish","type":"post","link":"http:\/\/re-photo.co.uk\/?p=9279","title":{"rendered":"Human Rights &#8211; 70 years"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"http:\/\/mylondondiary.co.uk\/2018\/12\/10\/20181210-d0183.jpg\" alt=\"\" width=\"450\" height=\"301\" \/><\/p>\n<p>Modern Human Rights law came out of the aftermath of the Second World War as a response to the barbarism of that war, with the UN in 1947 setting up a Human Rights Commission, chaired by Eleanor Roosevelt, which after consderable discussion came up in 1948 with the\u00a0non-binding <em>\u00a0Universal Declaration of Human Rights<\/em> which was<b>\u00a0<\/b>adopted by the United Nations General Assembly at at Palais de Chaillot, Paris on\u00a0the\u00a010 December 1948, 70 years to the day before this &#8216;<em>Shut Guantanam<\/em>o!&#8217; protest at the US Embassy by the London Guantanamo Campaign.<\/p>\n<p>December 10 is celebrated in countries around the world as\u00a0Human Rights Day\u00a0or <em>International Human Rights Day<\/em>, though it is an anniversary that passes almost unnoticed in the UK.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"http:\/\/mylondondiary.co.uk\/2018\/12\/10\/20181210-d0025.jpg\" alt=\"\" width=\"398\" height=\"600\" \/><br \/>\n<small>Almost 17 years &#8211; since January 11th 2002<\/small><\/p>\n<p>When the Council of Europe (not to be confused with the EU) was set up in 1949, it immediately began work, led by\u00a0Sir\u00a0<a class=\"mw-redirect\" title=\"David Maxwell-Fyfe\" href=\"https:\/\/en.wikipedia.org\/wiki\/David_Maxwell-Fyfe\">David Maxwell-Fyfe,<\/a>\u00a0a British MP who had been a prosecutor at the Nuremberg trials, on a\u00a0European Convention on Human Rights, completed in 1950 and ratifed three years later, with the\u00a0<a title=\"European Court of Human Rights\" href=\"https:\/\/en.wikipedia.org\/wiki\/European_Court_of_Human_Rights\">European Court of Human Rights<\/a>\u00a0 established in Strasbourg to oversee it.<\/p>\n<p>The Council of Europe now has 47 member states, including almost all those with any territory in Europe such as Turkey and Russia, along with Iceland, and is thus a much wider body than the EU<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"http:\/\/mylondondiary.co.uk\/2018\/12\/10\/20181210-d0129.jpg\" alt=\"\" width=\"398\" height=\"600\" \/><\/p>\n<p>In 1998, the\u00a0UK\u00a0Human Rights Act was passed, incorporating the European Convention on Human Rights\u00a0 into domestic British law; it sets out the fundamental rights and freedoms that everyone in the UK is entitled to\u00a0and means they can be argued in British courts rather than having to go to Strasbourg. It\u00a0came into force in the UK in October 2000.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"http:\/\/mylondondiary.co.uk\/2018\/12\/10\/20181210-d0235.jpg\" alt=\"\" width=\"450\" height=\"301\" \/><\/p>\n<p>The protest was held outside the US embassy in Nine Elms, London because the US has been clearly contrravening the\u00a0Universal Declaration of Human Rights in its treatment of prisoners held at Guantanamo (as well as in other secret military prisons in countries around the world.)<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"http:\/\/mylondondiary.co.uk\/2018\/12\/10\/20181210-d0226.jpg\" alt=\"\" width=\"450\" height=\"298\" \/><\/p>\n<p>The US\u00a0activities are a violation of many of the articles of the Universal Declaration of Human Rights, but particularly:<\/p>\n<p><em>Article 5<br \/>\nNo one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.<\/em><\/p>\n<p>and<\/p>\n<p><em>Article 9<br \/>\nNo one shall be subjected to arbitrary arrest, detention or exile.<\/em><\/p>\n<p>But the UDHR was a non-binding declaration and its provisions have never been incorporated into US law, although there are some similar provisions in the US Bill of Rights (which were\u00a0based on\u00a0those in the 1689 UK Bill of Rights.)<\/p>\n<p><a href=\"http:\/\/mylondondiary.co.uk\/2018\/12\/dec.htm#udhr70\" target=\"_blank\" rel=\"noopener\">70 years of Human Rights<\/a><br \/>\n______________________________________________________<\/p>\n<p align=\"center\"><small>There are no adverts on this site and it receives no sponsorship, and I like to keep it that way.
